Terms of Service

These Terms are an agreement between you and LAZYBIRD COMPANY LIMITED (CÔNG TY TNHH LAZYBIRD), enterprise code 5901238832, 974 Lê Duẩn, An Phú Ward, Gia Lai Province, Vietnam ("Lazybird", "we", "us"). They cover lazybird.app, the Lazybird Studio, the Lazybird API and any related services (the "Services").

By creating an account or using the Services, you agree to these Terms, our Acceptable Use Policy and our Privacy Policy. If you use the Services for a company or other organization, you agree on its behalf and confirm you're authorized to do so.

1. Eligibility

You must be at least 16 years old to use the Services.

2. Your account

  • Give accurate information and keep it up to date.
  • Keep your sign-in details and API keys secret. You're responsible for everything done through your account and keys.
  • Tell us right away at support@lazybird.app if you think your account or a key has been compromised.
  • One person per account unless your plan includes team seats.

3. Your content and outputs

3.1 What counts as your content

"Input" is what you give the Services: scripts, text, uploads, voice recordings, prompts. "Output" is what the Services generate for you: audio, video and voices.

3.2 You own your input and output

As between you and Lazybird, you keep all rights you have in your input, and we assign to you any rights we have in your output. Commercial use of output needs a paid plan with commercial rights, as shown on our pricing page. Output you create on such a plan can be used commercially without time limit, even after your subscription ends.

Because AI output can be similar for different users, other people may receive output similar to yours, and you don't get exclusive rights in output that isn't unique to you.

3.3 The license you give us

You give Lazybird a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display your input and output only as needed to provide, secure and support the Services for you (and for published voices, see 3.4). This license ends when you delete the content or your account, except for copies we must keep by law or that remain in backups until they expire.

We don't use your input or output to train AI models.

  • Publishing a voice makes it available to other Lazybird users. You give Lazybird and other users a worldwide, non-exclusive, royalty-free license to generate speech with that voice through the Services, and to use that speech under section 3.2. You can unpublish or delete the voice at any time; that stops new generations, but speech already generated with it can still be used.
  • Share links let anyone with the link view the project's script and audio and copy the project. You're responsible for what you share.

3.5 You are responsible for your input

You confirm that:

  • you own your input or have every right, license and permission needed to use it with the Services;
  • for any voice recording, you are the speaker or have the speaker's clear permission to clone their voice and use it as you intend;
  • your input and your use of output follow these Terms, the Acceptable Use Policy and the law.

You're responsible for how you use output, including labeling it as AI-generated where the law or a platform requires it.

4. Acceptable use

You must follow our Acceptable Use Policy. In short: no cloning a voice without permission, no deceptive impersonation, no fraud, no illegal or harmful content, and no abuse of the Services or the API.

We may review, block or remove content, and limit or suspend accounts, to enforce these Terms or protect people. We're not required to monitor content.

5. Plans, payments and credits

5.1 Fees

Plans and other purchases cost what's shown when you buy. Prices may change; changes to a subscription apply from your next billing period, and we'll tell you in advance.

5.2 Merchant of Record

Purchases are sold by Lemon Squeezy, our Merchant of Record. Lemon Squeezy's terms also apply to the purchase, and it handles payment, taxes, invoices and refunds.

5.3 Subscriptions

Subscriptions renew automatically each billing period until you cancel. You can cancel at any time from Billing in your account settings.

5.4 Credits and usage limits

Each plan includes a monthly credit allowance, used when you generate audio. It resets every month, and unused monthly credits don't carry over.

Free-plan limits are shown on our pricing page and may change.

5.5 Refunds

Not happy? Email support@lazybird.app within 7 days of a payment and we'll refund it in full, as long as you've used less than 10% of the credits for that billing period. This applies to every payment, including subscription renewals. After 7 days, or once 10% or more of the credits are used, payments are non-refundable except where the law says otherwise. Refunds are processed through Lemon Squeezy.

6. API

If you use the Lazybird API:

  • keep your API keys secret and don't share them or embed them in public code;
  • follow the rate limits and usage limits that apply to your plan;
  • don't use the API to build a product that resells raw access to the Services or competes with them by reselling our voices, unless we agree in writing.

7. Our intellectual property

Lazybird owns the Services, including the software, models, built-in voices, website and brand. These Terms don't give you any rights in them except the right to use the Services as allowed here. If you send us feedback, we may use it freely without owing you anything.

If you believe content on Lazybird infringes your copyright, your voice or your other rights — including a voice cloned without permission — email support@lazybird.app with:

  • who you are and how to contact you;
  • what's being infringed (e.g. your voice or the work);
  • where it is on Lazybird (a link or voice name);
  • a statement that you believe in good faith the use isn't authorized, and that your notice is accurate.

We'll review it and may remove the content and notify the user who posted it, who may respond. We suspend repeat infringers.

9. Suspension and termination

  • You can stop using the Services and delete your account at any time in Settings → Account (cancel any renewing subscription first).
  • We may suspend or end your access at our sole discretion, including if you break these Terms or the Acceptable Use Policy, don't pay, create risk or legal exposure for us or others, or if we stop offering the Services. Where reasonable, we'll tell you first.
  • What happens after: your right to use the Services ends. Account deletion removes your content as described in the Privacy Policy. Output you already downloaded remains yours under section 3.2.
  • Sections that by their nature should survive (for example 3.2, 3.5, 7, 10–14) continue after termination.

10. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will be uninterrupted, error-free, or that output will be accurate or fit for your purpose. AI output can be wrong, mispronounced or unexpected; check it before you rely on it.

11. Limitation of liability

To the fullest extent allowed by law, Lazybird and its owners, staff and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Services. Our total liability for any claim is limited to whichever is higher: the amount you paid us in the 12 months before the claim, or USD 100.

Nothing in these Terms limits liability that can't be limited by law.

12. Indemnity

You'll defend and indemnify Lazybird against claims, losses and costs (including reasonable legal fees) arising from your input, your use of output, or your breach of these Terms, the Acceptable Use Policy or the law — including claims by a person whose voice you cloned.

13. Governing law and disputes

These Terms are governed by the laws of Vietnam. If something goes wrong, please contact us first at support@lazybird.app and we'll do our best to sort it out.

14. Changes to these Terms

We may update these Terms. For material changes we'll update the date and tell you by email or in the product before they take effect. If you keep using the Services after that, the new Terms apply; if you don't agree, stop using the Services and delete your account.

15. General

  • Entire agreement: these Terms, the Acceptable Use Policy, the Privacy Policy and any order terms are the whole agreement between you and Lazybird about the Services.
  • Severability: if a part is found unenforceable, the rest stays in effect.
  • No waiver: not enforcing a right isn't a waiver of it.
  • Assignment: you can't transfer these Terms without our consent; we may transfer them in a merger, acquisition or sale of assets.
